The Illinois Public Aid Code specifies in the Illinois Compiled Statute 305 ILCS 5/3-8 states that if the estate of a deceased Medicaid recipient is insufficient to pay for funeral expenses then the Illinois Department of Human Services will provide the funds necessary to meet the costs of a funeral and burial.
